It is permissible to take the amount paid by the auction participant if it is equivalent to the actual cost of conducting the auction, such as the cost of the terms and conditions booklet. Anything in excess of that is considered prohibited gambling (maysir), because it is a guaranteed loss in exchange for a potential gain.
