What is the ruling on one who says to his wife: "I divorce you." Does divorce take place?

A husband's statement to his wife, "I divorce you," is not an explicit declaration of divorce, so it does not effect a divorce unless he intended it. The jurists have stipulated that a man's statement to his wife, "I am divorced from you," is considered a metaphorical expression (kinayah) by which divorce occurs if he intended it, and does not occur if he did not intend it.
