What is the ruling on a Muslim woman taking money from her infidel father's inheritance in Germany, knowing that she is in need and the alternative is for the government to confiscate the money?

The scholars differed regarding a Muslim inheriting from a non-Muslim. The majority held the view of prohibition, based on the Prophet's (peace be upon him) saying: "A Muslim does not inherit from a non-Muslim, nor does a non-Muslim inherit from a Muslim." However, a group of early and later scholars held that a Muslim inherits from a non-Muslim, but not vice-versa, interpreting the prohibition to apply only to the belligerent non-Muslim. Among those who held this view are Mu'adh, 'Abdullah ibn Ma'qal, Masruq, Sa'id ibn al-Musayyib, Ibrahim al-Nakha'i, and Ishaq. It is also the chosen opinion of Sheikh al-Islam Ibn Taymiyyah and a number of contemporary scholars. Accordingly, a Muslim woman may inherit from her non-Muslim father.
