How is the inheritance of a 76-square-meter house, half of which is owned by the deceased and the other half by his wife, divided among his heirs: a wife, three sons, two daughters, two full brothers, three full sisters, and three sons of a full brother?
Writing half of the house in the wife's name does not make it her property unless she takes possession of it. If the husband dies while residing in it, the house belongs to all heirs. However, if the wife already owned half of the house, it does not enter the inheritance. If the heirs are limited to the wife, sons, and daughters, the wife receives one-eighth due to the presence of a lineal descendant, and the remainder is for the sons and daughters by ta'sib (residuary heirship), with the male receiving the share of two females. Nothing goes to the brothers, sisters, and their children, as they are excluded by the son. The inheritance is divided into sixty-four shares: the wife receives eight shares, each son receives fourteen shares, and each daughter receives seven shares. It is advisable to refer inheritance matters to courts to verify all rights, debts, and wills.
