Is it permissible to take a commission for mediation between an investor and the party invested in, and how is this commission determined? And is it permissible to sell communication scratch cards and charging cards that are obtained at a certain discount, then sold at their original value, while the investor also receives another commission from the parent company?

The legal ruling for investing money in the business of selling phone lines and scratch cards is summarized in two cases:

1. Mudarabah contract: If the capital is from one party and the work is from the other. 2. Shirkah contract: If both parties share in the capital and work.

Conditions for both cases:

1. Profit: Agreement on a known percentage of the profit (e.g., 60% for the owner, 40% for the worker), not from the capital. 2. Capital: There is no guarantee for the capital except in cases of transgression or negligence on the part of the worker. 3. Loss: In Mudarabah, the worker loses their effort and the owner loses their capital. In Shirkah, the loss is proportionate to each partner's share in the capital. 4. Monetary Capital: The capital must be cash, either actually or constructively. If it consists of assets, they must be valued. 5. Duration and Withdrawal: It is permissible to specify a duration for the contract. Weekly or monthly withdrawals are considered on account and are settled at the end of the term. 6. Commissions: No partner is allowed to exclusively receive any commission or portion of the profit without the other. Rather, all commissions are added to the profits and distributed according to the agreed-upon percentage.

As for investing others' money in exchange for a percentage of the profit:

This may be permissible as a fee for brokerage and mediation. It is permissible for the fee to be a known percentage of the profit, and this is permissible with the agreement of both parties. It is preferable for the fee to be a fixed amount to avoid the disagreement of those who prohibited the percentage.
