Regarding the brother who does not pray: If the prevailing opinion in your country is that abandoning prayer constitutes disbelief, then he does not inherit from his Muslim brother. However, if the prevailing opinion is that he is not a disbeliever, then he does inherit. An ordinary person is excused for following the scholars of his country in this matter.
