Is it permissible to pay the expiation for delaying the making up of fasts from money endowed to Allah? Or must the husband pay it?

Scholars differ regarding the necessity of a specified charity (sadaqah) before it is handed over to the poor. Some are of the view that it becomes binding merely by declaration, even if not yet taken possession of. Others hold that it is not binding and does not transfer out of the giver's ownership except through actual possession and acquisition; this is the view of the Malikis and Hanbalis.

According to the view that charity does not become binding except through possession, it is permissible for the questioner to use the designated amount for charity to pay the expiation (kaffarah) that is obligatory upon her. It is also permissible for the husband to pay the expiation on behalf of his wife with her permission. However, after the poor person takes possession of the charity, it is not permissible to revoke it, by scholarly consensus.
