What is the ruling of Islamic law on dealing with a financier who demands the return of his capital after a printing machinery import deal has fallen through, and is Zakat obligatory for paying off this debt?
It is recommended to supplicate for the alleviation of distress and the repayment of debt, especially the well-known supplication: "O Allah, suffice me with Your lawful against Your unlawful, and enrich me by Your grace, sparing me from need of anyone else." If the money was taken with the intention of a business partnership (Mudarabah), then the loss is borne by the capital, and the worker (Mudarib) is not responsible for guaranteeing the capital, nor is he obliged to return the money or part of it; because that contradicts the essence of the Mudarabah contract. If the financier stipulates a guarantee for the capital, the contract is invalid. The Mudarib is a trustee and does not guarantee loss unless there is negligence on his part. Likewise, it is not permissible to take money for delayed payment. It is advised to seek assistance from righteous people to mediate in resolving the problem.
