Does a divorce pronounced by the husband under threat of death or suicide take effect, knowing that it is the second divorce and they have a child?
Allah has legislated marriage for the continuation and stability of marital life. This does not mean it will be free of problems; rather, spouses must exercise wisdom when problems arise and resolve them through lawful means. Caution must be exercised against the interference of Satan, who seeks to separate spouses. If a wife is harmed by her husband’s ill-treatment, she has the right to seek divorce, but she should do so deliberately and not hastily. A wife’s threat to kill herself, her husband, or to strangle him in order to obtain a divorce is a reprehensible act from which one must repent. A divorce issued under duress due to fear of perishing does not take effect. Suicide and killing oneself are grave crimes, and their consequences are severe.
