The question

What is the ruling on dealing with Islamic banks, such as purchasing sukuk with a return or taking a loan from them to buy a car or a house? What is the ruling on taking a loan secured by funds deposited in the bank that generate profits? And does a bank’s declaration that it is Islamic make its dealings and profits permissible, or is it necessary to verify its transactions?

The answer

The basic principle regarding dealing with Islamic banks is that there is no objection to it, as long as the transaction is permissible. However, merely labeling a bank as "Islamic" does not necessarily mean that all its transactions are valid, and they may vary in their degree of Sharia compliance. If it becomes clear to the client that the bank is conducting a transaction that violates Sharia, then it is not permissible to deal with it in that specific transaction.

It is advisable to consult specialized scholars regarding the Sharia compliance of each transaction one intends to undertake with Islamic banks.

Investing in sukuk has its Sharia guidelines, and taking a Qard Hasan (interest-free loan) or engaging in a Tawarruq transaction with an investment deposit as collateral with the bank is generally permissible.

If a person invests his money in an Islamic bank and no Sharia violations in the investment are proven to him, then there is no objection to him benefiting from the profits. If the bank commits a Sharia violation without the investor's knowledge, the sin is on the bank, not on the investor.

One must investigate the bank with which they invest, as some banks are better than others in adhering to Sharia guidelines, and scholars knowledgeable about the bank's situation are the most suitable to refer to for fatwas.
