Is it permissible for me to stop praying Fajr in the mosque and suffice with praying at home if there is a risk of arrest and torture due to consistently performing it in the mosque in a foreign country?

Previous fatwas have clarified the virtue and obligation of congregational prayer in the mosque, and that staying away from it is not permissible except with a valid excuse. Therefore, if a person's presence at the mosque would result in definite harm and an unbearable severe punishment, then it is permissible for him to stay away and pray at home, because he is legally excused. It should be said: "Allah willed" (sha'a Allah) or "Allah decreed" (qaddara Allah), instead of: "circumstances willed."
