How is the inheritance of a deceased person who left behind a wife, two sons, and two daughters distributed, given that he left an old house built on Waqf land, which the eldest son renovated, knowing that he pays a monthly rent to the Endowments?

If the deceased leaves behind only a wife, two sons, and two daughters, the wife receives one-eighth (1/8) due to the presence of lineal descendants. The remainder is for the two sons and two daughters by virtue of ta'sib (agnatic succession), with the male receiving a share equivalent to that of two females. The inheritance is divided into 48 shares: 6 shares for the wife, 14 shares for each son, and 7 shares for each daughter.

The house owned by the endowments (Awqaf) does not enter into the estate. However, if the deceased was renting it and the contract expired, the ownership of the usufruct transfers to the heirs.

As for what the son added to the endowed house, jurists have differed regarding its ownership, and it is necessary to refer to the Sharia court to resolve the dispute.
