How is an inheritance consisting of a house with four apartments, a vacant plot of land, and agricultural land measuring 80 qirats distributed among a mother and eight children (5 males and 3 females), taking into account that the mother sold her share of her father's inheritance to contribute to building the house?

Real estate properties are appraised, added to the deceased's estate, and then distributed among the heirs after fulfilling debts and bequests (within one-third of the estate), including the mother's right, which she contributed to building the house if she did not gift it.

If the heirs are limited to those mentioned: - The wife receives one-eighth due to the presence of a lineal descendant, as Allah Almighty says: "But if you have a child, then for them is one eighth of what you leave." - The sons and daughters receive the remainder by ta'sib (residuary heirship), with the male receiving the equivalent of the share of two females, as Allah Almighty says: "Allah instructs you concerning your children: for the male, what is equal to the share of two females."

This is if the mentioned mother is the deceased's wife and the mother of his children. However, if she is the deceased's mother, she receives one-sixth due to the presence of a lineal descendant, as Allah Almighty says: "And for his parents, each of them gets one sixth of what he left if he has a child."

Estate matters must be referred to the Sharia courts for investigation and to ensure there are no other heirs, bequests, debts, or other rights taking precedence over the heirs' rights.
