What is the ruling regarding a man saying to his wife: "You are unlawful to me like my mother and my sister," and then following that with: "Go, you are divorced by three?"

The husband's statement to his wife, "You are forbidden to me like my mother," is considered an explicit Dhihar, according to the preponderant opinion, especially when accompanied by anger. Since he divorced her with three pronouncements, she has become irrevocably separated from him (Baynunah Kubra) and is forbidden to him until she marries another husband, he consummates the marriage with her, and then he divorces her. If this occurs, he is permitted to contract marriage with her again. However, he must not touch her until he performs the expiation for Dhihar, which is freeing a slave. If he cannot find one, then fasting for two consecutive months. If he is unable to do so, then feeding sixty needy persons, based on the Almighty's saying: "And those who declare Dhihar from their wives and then return to that which they said – then [there must be] the freeing of a slave before they touch one another. That is [said] to remind you; and Allah is Acquainted with what you do. And he who does not find [a slave] – then a fast of two consecutive months before they touch one another. And he who is unable to do so – then the feeding of sixty needy persons." {Al-Mujadilah: 3-4}. It is advisable to present this matter to the Sharia courts or consult with scholars directly.
