If a husband divorces his wife with the third divorce, after having taken her back following the second divorce and before the expiration of her waiting period ('iddah), then she becomes irrevocably separated from him with a major divorce (baynunah kubra). She does not become lawful for him again unless she marries another man in a genuine marriage of desire, and then that man divorces her or dies, and her 'iddah expires.
However, if he did not take her back after the second divorce until her 'iddah expired, and then he divorced her a third time, this divorce is not valid because she is no longer his wife. In this case, he can contract a new marriage with her, but he cannot take her back without a new contract.
