Is it permissible to take back one's wife after obtaining the third divorce paper from the ma'dhun while angry, without uttering the divorce, and with both spouses desiring to return, but the wife's family refusing it?

Divorce is not limited to saying, "You are divorced," but rather occurs with every explicit utterance, or with a word that implies separation accompanied by the intention of divorce, or by writing with the intention of divorce.

If you did not utter any of these when you sought to obtain a divorce document, and you did not intend to effect a divorce, then no divorce occurs, and your wife remains under your conjugal bond.

However, if you uttered an explicit divorce, or a veiled statement with the intention, or wrote the divorce intending to effect it, then it is binding, and your wife becomes unlawful for you if you had divorced her twice before. She does not become lawful for you again until she marries another man and then is divorced from him after consummation.

It is advisable to consult the Sharia court or scholars to precisely clarify what you uttered, for the divorce might have occurred without your knowledge.
