What is the ruling on the recurrence of marital disputes and the husband threatening his wife with expulsion, given the wife's refusal to return after leaving the house?
Your statements to your wife: "You will call your family to come and take you" and "If you leave, by God, you will not return home" are two allusions (kinayat) to divorce. Divorce does not occur with them unless you intended it when uttering them. If your wife returns home after you said, "By God, you will not return home," an expiation for a broken oath (kaffarat ) becomes incumbent upon you. A wife leaving the home without her husband's permission is an act of defiance (nushooz), and it is her duty to retract this defiance and return to the marital home. We recommend mutual understanding and the intervention of sensible people for reconciliation. The intervention of family during disputes should be for the purpose of reconciliation, not instigation.
