Is it permissible for the husband to marry another woman after trust has been lost and it has become impossible to live with his wife who left the marital home? And is she entitled to alimony after her disobedience and insubordination? And does the husband sin if he does not divorce her?

If a wife refuses her husband's bed and leaves his house without his consent, she is considered disobedient (nashiz), and she is not entitled to maintenance (nafaqah) or housing (sukna) until she returns to his obedience. It is not permissible for her to seek divorce except due to harm inflicted upon her. If she seeks it in this situation, the husband is not obliged to divorce her until she returns to his obedience or redeems herself with money. The husband is not bound to fulfill his promise not to marry another woman due to her shortcomings, and if he swore an oath to that effect, no expiation is required of him. It is advisable not to hasten divorce due to its harms and negative consequences, especially for children.
