The basic principle concerning divorce is its legality as a solution to the marital bond when happiness and stability are not achieved. It may be disliked (makruh) if done without reason, or forbidden (haram) if it is an innovative divorce (bid'i) (during menstruation or a period of purity in which intercourse occurred). The one pronouncing the divorce must be an adult, sane, and acting voluntarily (not under duress). The divorced woman does not have the right to refuse reconciliation unless it is proven that the husband is harming her, in which case she refers her matter to the judge to remove the harm or pronounce a divorce.
