If the husband pronounces divorce three times, being aware and acting voluntarily, a major irrevocable divorce (baynunah kubra) occurs. The husband is not permitted to take his wife back unless she marries another man in a genuine marriage, and then he divorces her or dies, and her waiting period () ends. If the husband denies that the divorce occurred, but the wife is certain that three divorces took place, then it is not permissible for her to remain with him, and she must seek to free herself from him through khul'. However, if he divorced her only twice, he may take her back before the expiration of her waiting period (iddah). And if he divorced her fewer than three times and did not take her back until her waiting period (iddah) expired, a minor irrevocable divorce (baynunah sughra) occurs. Such matters should be presented to a court or trusted scholars.
