What is the ruling on a husband who wants to divorce his wife in fulfillment of his father's will, who ordered him to divorce her before his death, and who refrained from spending on his wife and children on the pretext of his father's illness, and what is the ruling on the wife who sees herself as the cause of this?
If a husband wishes to divorce his wife merely due to his father’s will, believing that fulfilling it is obligatory, he is mistaken. Such a will is not obligatory to fulfill. If a husband abandons his wife and children without a valid excuse, he is unjust, and his failure to pay the obligatory maintenance is forbidden and a great injustice. "It is enough sin for a man to neglect those he is responsible to feed," and "It is enough sin for a man to withhold from those whose sustenance he possesses." The Prophet, peace and blessings be upon him, warned against neglecting the rights of the two weak ones: the orphan and the woman. Divorce is dislikable (makrooh) in Islamic law if it is without need, and some scholars have even deemed it forbidden. As for the wife, if nothing has been issued from her that necessitates divorce, such as disobedience (nushooz), then there is no sin upon her.
