It is permissible to pay with banknotes instead of gold and silver if the banknotes stand in place of gold and silver, while observing the conditions for selling a debt of one currency for another. The debt must be due, and it must be sold at its value on the day of demand, and the two sellers must not separate with any part of it remaining between them.
If the debt is gold, the debtor may either pay an equivalent amount or pay its value in cash at the current price. If a debt is fixed in the obligation as a specified gold or silver currency, and its value increases or decreases, the debtor is not obligated to pay anything other than it.
