Is it permissible to continue an unwilling marriage due to threats of imprisonment resulting from a penalty clause in the list of movables that was not seen at the time of signing, or is divorce permissible in this case where cohabitation has become impossible?
The presence of affection and harmony between spouses is Islamically مطلوب (required/desired) for family stability. This requires patience and overlooking some mistakes. Allah Almighty says: "And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good." (An-Nisa: 19). The Prophet (PBUH) said: "A believing man should not hate a believing woman. If he dislikes one of her characteristics, he would be pleased with another." If reconciliation becomes impossible due to the wife's bad character and conduct, divorce is permissible, but it is better to attempt reconciliation first, due to the harms that result from divorce.
The husband can involve religious people as mediators for reconciliation or to rule on divorce. The wife is permitted to insist on her right to the deferred dowry. A man marrying a second wife is permissible if he is capable of being just between them. Severing ties of kinship is not permissible; it is forbidden. The Prophet (PBUH) said: "The severer of kinship ties will not enter Paradise," and "Whoever maintains ties with you, I maintain ties with him; and whoever severs ties with you, I sever ties with him." The one who maintains ties is he who maintains his kinship when it is severed. Customs and traditions are to be followed as long as they do not contradict Islamic law.
