Does a divorce take place if a man says to his wife: "If you do not bring so-and-so of our neighbors, then you are divorced," while the wife had already sold the item in question and used its price for repairs in the house, and she informed him of that, but he did not believe her?

A contingent divorce, according to the majority of scholars, occurs when the condition it is contingent upon is met, unlike Ibn Taymiyyah, who does not consider it to occur if the intent was merely to threaten. In such cases, it reverts to the husband's intention. If he intended to make the divorce contingent on the non-delivery of the item, regardless of the wife's disposition of it, then the divorce occurs upon its non-delivery. However, if he made the divorce contingent because he suspected she gave it to the neighbors, but it later became clear that she sold it and did not give it to the neighbors, then the preponderant view is that the divorce does not occur. It is preferable to present such matters to a Sharia court or to trusted scholars.
