What is the ruling on a husband forcing his wife to exit the state of ihram for Umrah by means of sexual intercourse during the daytime in Ramadan, under the pretext of travel, and what is the ruling on applying perfume out of forgetfulness during Umrah?

It would have been better for the husband to assist his wife in completing the 'Umrah (definition) unless it caused him harm. If the 'Umrah was supererogatory, the husband may command her to exit the state of ihram (definition), which is the view of the majority of jurists. However, if it was obligatory according to the Shafi'is, he may command her to exit, but not according to the Hanbalis. If he commands her to exit the state of ihram, she exits like one who is prevented from proceeding: she slaughters a sacrificial animal (hady), intends to exit, and shortens her hair. If she cannot find a sacrificial animal, she fasts for ten days. Committing prohibitions like applying perfume or engaging in sexual intercourse does not cause her to exit the state of ihram, and she must offer a fidyah (definition) (expiation), but she does not have to make up the 'Umrah if it was supererogatory. If the husband commands her to exit the state of ihram, she must do so promptly. If she refuses, he may engage in sexual intercourse with her, and there is no sin upon him. However, if sexual intercourse occurs before exiting the state of ihram without the husband's command, the 'Umrah is invalidated, and she must slaughter a large animal (badanah) and distribute it among the poor of the Haram (definition), make up the 'Umrah, and complete the invalidated 'Umrah. But if sexual intercourse was by the husband's command, she exits the state of ihram by what was mentioned (shortening hair and slaughtering a sacrificial animal or fasting), then she makes up the 'Umrah and slaughters the large animal.
