What is the ruling regarding a husband having sexual intercourse with his wife who has entered into a state of Ihram with the intention of performing Umrah, and then her husband prevented her from completing it? And is there anything upon her for his having intercourse with her, especially since she said upon forming her intention: "unless I am prevented by a preventer"?

If the 'Umrah is obligatory (the obligatory 'Umrah or a vowed 'Umrah) or a supererogatory 'Umrah performed with the husband's permission, the husband has no right to prevent his wife or make her abandon it. She must complete her ritual. If he forces her to abandon it, she is considered like someone who is prevented from continuing (muḥṣarah). If she stipulated when entering iḥrām that her place of release would be wherever she was prevented, then she is released and owes nothing.

However, if the 'Umrah is supererogatory and she did not seek her husband's permission before entering iḥrām, he may make her abandon it, and she must obey him in abandoning it. She then releases herself like a muḥṣar, by sacrificing a Hady (sacrificial animal); if she cannot find one, then by fasting ten days. But if he gave her permission for the supererogatory 'Umrah and she then entered iḥrām, he cannot retract his permission or make her abandon it.

In general, if a woman stipulates when entering iḥrām that she will be released wherever she is prevented, this condition benefits her, and she owes no Hady, qada' (making up), or fasting.
