What should a man do who has a son with an apostate wife and desires to emigrate and marry a woman who wears the niqab, given his mother's advice to remain by his son's side in a non-Islamic country to raise him upon Islam?

It is not permissible to abandon one's son to the disbelievers. Every effort must be made to rescue him from his mother and her country so that he may be with his father in his country, as this is his legitimate right. Islamic centers and lawyers should be consulted, and money should be spent or a custody case filed. If current attempts are unsuccessful, and remaining in France will enable his custody later, then one may stay close to him. If there is no benefit in residing there, then it is preferable to return to Morocco while frequently visiting him to maintain his connection with him.
