Does a wife become forbidden to her husband if he swore an oath upon her that she not speak to another man, or if she allowed a foreign man to touch her body and kiss her, and is she entitled to seek a divorce due to harm?

A married woman's conversation with foreign men or her engaging in an emotional relationship with them is a reprehensible act that necessitates sincere repentance, for its sin is great. The woman must fear Allah to preserve her honor, the honor of her family, her husband, and her children. For, through her fear of Allah Almighty, her children will be protected from all evil and harm. Hence, Allah Almighty says: (And let those [therein] fear who, if they left behind them weak offspring, would fear for them. So let them fear Allah and speak words of appropriate approval) [An-Nisa:9]. It is narrated that Muhammad ibn Sirin, addressing his son, said: "O my son; I prolong my prayer hoping that I will be preserved in you" – and he recited His saying, the Most High: (And their father was righteous) [Al-Kahf:82].

If the husband conditioned the prohibition of his wife on her speaking to a man other than him a second time, and that occurs, the wife becomes forbidden to him. The most preponderant view is that the prohibition of the wife refers back to the husband's intention, whether he intended divorce, zihar (a form of declaring one's wife unlawful), or an oath.

It is not permissible to seek divorce without a legitimate reason. The woman must thwart the devil's opportunity by repenting and rectifying herself, and not seek divorce, because the devil strives to separate families. The Messenger of Allah, peace and blessings be upon him, said: "Indeed, Iblis places his throne upon water, then he sends out his detachments. The lowest in rank to him is the greatest in causing mischief. One of them comes and says, 'I did such and such,' and he says, 'You have done nothing.' He said, then one of them comes and says, 'I did not leave him until I separated him from his wife' — he said — so he brings him closer to him and says, 'Yes, you are the one.'"
