Who is the guardian (wali) of a girl for marriage in the event of the death of her father, paternal grandfather, and maternal uncles, and with the presence of one brother who is mentally ill and another who is impious and abusive towards her and her religion, and her paternal uncles abandoning her? And will she be sinful if Allah takes her soul while she is in dispute with those who wronged her?

Allah has magnified the status of kinship ties (womb) and commanded their maintenance, while forbidding their severance. Kinship ties are more important than the fleeting pleasures of this world. The injustice of the brother and paternal uncles towards the girl is a grave offense. They should be prayed for and advised by wise people.

As for the guardianship of the girl's marriage (wilayat an-nikah), her mentally unstable brother is not fit to be a guardian, nor is her elder brother who blasphemed, because a disbeliever has no guardianship over a Muslim woman. The guardianship then passes to the next in line in the hierarchy, provided he meets the conditions. If there is no qualified guardian among her brothers' sons, then the guardianship transfers to one of her paternal uncles, bearing in mind that justice is not a condition for marriage guardianship.

Regarding the injustice and harm, if she does not forgive the oppressors in this world, Allah will exact retribution for her on the Day of Judgment. Forgiving them brings greater reward and higher ranks.
