Is it permissible to print and sell old books, which were uploaded for free on the internet by volunteers who stipulated that they should not be sold, after reformatting them for printing?

There is no harm in printing old books whose authors or publishers do not have copyrights, or who had copyrights and permitted printing; because the default is permissibility of printing, publishing, and profiting from it, unless the author or publisher prohibits it, in which case their right must be observed. The resolution of the Islamic Fiqh Academy states that "copyrights and invention rights are legally protected, and their owners have the right to dispose of them, and it is not permissible to infringe upon them." Likewise, it is stated in "Fatawa of the Permanent Committee" that "there is no impediment to recording beneficial tapes and selling them, and photographing books and selling them; because this aids in disseminating knowledge; unless their owners prohibit it, in which case their permission is necessary." If someone publishes a book that has no copyrights or publishing rights and makes it a waqf (endowment), then if he merely photographed it, he has no right to prevent others from printing it. However, if he re-typeset and re-formatted it, he has the right to prevent others from benefiting from his work and effort, and whoever wishes to print the book then should re-format it. Accordingly, it is permissible to download the book from a charitable waqf and then re-format it for printing for commercial purposes.
