If a husband swears by triple divorce not to sit in a specific place, and he intends a particular situation, then divorce does not occur if he sits in the same place in a different situation; because an oath is based on the intention of the swearer. However, if he swears never to sit there at all, and he does sit, then three divorces occur according to the majority of scholars, and his wife becomes unlawful to him, unless she marries another husband. Sheikh Al-Islam Ibn Taymiyyah is of the opinion that he must pay expiation for an oath (kaffarat yamin) if he did not intend divorce, or a single divorce if he did intend it.
