The majority of scholars hold that swearing an oath by divorce results in its occurrence if the condition sworn upon is met. However, Sheikh al-Islam Ibn Taymiyyah is of the view that its ruling is that of an oath; if the condition sworn upon is met, the one who swore the oath is liable for an expiation for breaking an oath, and no divorce occurs. The fatwa adopted by us is the opinion of the majority, that one divorce occurs if it is the first or second divorce, in which case the wife can be taken back. But if it is the third divorce, she is not lawful for him until she marries another husband. We emphasize that swearing an oath by divorce is impermissible.
