How can one act to solve the problem of the wife's mother refusing the continuation of the marriage? And what is the Sharīʿah's view on a mother who prevents her daughter from her lawful husband, and on a wife who does not seek reconciliation and flees from her husband?
If the marriage contract fulfills the Islamic conditions and pillars, then it is valid, even if it is not officially documented, and all its full legal effects apply. The wife is lawful for her husband, and the husband has the right to take possession of his wife immediately upon the contract. It is not permissible for her family to delay the consummation except for the short customary period required for her to prepare herself. What the wife’s family does by instigating her to separate from her husband is forbidden (takhbib). Likewise, the wife's evasion and failure to respond to her husband are not permissible. It is advisable to seek out people of religion and wisdom to mediate between the spouses and the wife's family.
