Is it permissible to purchase sheep where part of the payment is made per kilogram, on condition that the weighing and final price determination be based on the old price at the time of delivery two months later?

Scholars have differed on the ruling concerning selling live animals by weight. The Permanent Committee for Issuing Fatwas and Sheikh Ibn Baz permitted it, based on the general permissibility of transactions unless prohibited by Sharia (definition), and because it involves neither gharar (definition) (excessive uncertainty) nor jahalah (ignorance). Conversely, Sheikh Ibn Uthaymeen and some scholars, such as the researcher Muhammad Sakhal Al-Majaji, prohibited it due to clear gharar and jahalah, citing the possibility of substances that increase weight without benefit or value, such as water in the animal's belly or the contents of the stomach and entrails, which are discarded.

The preponderant opinion is the permissibility of selling by weight, because selling by estimation (jazaf) is permissible, and weighing does not increase ignorance but rather refines it. Experts are able to estimate the proportion of meat. It is also permissible to fix the price and pay part of it in advance, because knowledge of the sold item and the price will be ascertained upon completion of the sale. This is similar to selling an item from a heap, where each 'qafiz' is for a dirham, or harvested crops where each 'qafiz' is for such-and-such amount, as the matter ultimately leads to knowledge of the sold item and the price.
