If a man says to his wife: "You are divorced until I marry another," intending thereby that she be divorced immediately and not return to him until after he marries another, then she is divorced instantly and does not return to him upon his marriage to another; for divorce does not accept temporal restriction.

However, if he intended to suspend her divorce upon his marriage to another, then the preponderant opinion is that the divorce occurs upon the fulfillment of the condition (marriage to another).
