The majority of scholars hold that divorcing based on a condition leads to the divorce taking effect once the condition is met, regardless of whether the husband intended to enact the divorce or merely to threaten. This is the prevailing fatwa. However, some, like Ibn Taymiyyah, are of the opinion that if the intention was not to enact divorce but merely to threaten, then the divorce does not occur, and an expiation for breaking an oath becomes obligatory.
