What should I do about my wife who refuses to return home and shows me disrespect, knowing that I married her after she was raped and covered for her, and her refusal to return has caused her father to faint?

The Shari'ah has granted guardianship (qawamah) to the husband and obligated the wife to obey him. If the wife leaves her home without his permission, she is disobedient (nashiz) and sinful. The husband then has the right to withhold financial support from her and discipline her.

If the wife's disobedience persists and cohabitation becomes impossible, divorce is preferable due to the potential for ongoing corruption and harm that maintaining the marriage might cause.

Regarding marriage before purification from fornication, scholars have differed on this matter. If the marriage fulfills the conditions, such as the presence of a guardian, it is valid according to those who permit it.

As for the child, if born six months or more after the marriage, he is attributed to the husband. If born in less than six months, he is not attributed to the husband but rather to his mother.
