Does a divorce occur if a husband angrily says to his wife, "Why didn't you marry men like these? Marry men like these," knowing that he had previously divorced her twice?

What this man said to his wife is an allusion to divorce (kināyāt al-talāq), and it constitutes a divorce if the husband intended divorce by it, according to the Hanafis and the well-known opinion among the Malikis. However, it does not constitute a divorce according to the Shāfiʿīs and Hanbalīs unless the husband intended it. A Muslim must be cautious about being lenient with divorce pronouncements, and a wife must serve her husband in her home.
