What are the legitimate rights of a wife whose husband traveled away from her after three months of marriage, did not provide her with independent housing, and wishes to divorce her, knowing that she is still a virgin?
If a man divorces his wife after consummating the marriage or after valid seclusion, she is entitled to the full mahr (both immediate and deferred) and must observe the waiting period ('iddah). However, if he divorces her before consummation or valid seclusion, she is entitled to half the mahr and is not required to observe an 'iddah, in accordance with the Almighty's saying: "And if you divorce them before you have touched them and you have already specified for them an obligation, then [give them] half of what you specified – unless they forego it or the one in whose hand is the marriage contract foregoes it. And that you forego is closer to righteousness. And do not forget graciousness between you. Indeed, Allah, of what you do, is Seeing." (Al-Baqarah:237).
