Is it permissible to bury a Muslim husband in France, knowing that if the fee for the land in which he is buried is not paid every ten years, the deceased will be exhumed and cremated, or placed in a grave with other deceased persons, who may be disbelievers? The husband should be buried in a Muslim cemetery. If one is not available, then in a place safe from exhumation or burning. The cost of burial comes from his wealth; otherwise, it falls upon his relatives; otherwise, upon the Muslim community, because burying the deceased is a communal obligation (fard kifaya). It is permissible to transport the deceased to a Muslim country, provided that his body parts are not dismembered, and that the transportation serves a benefit, such as to a virtuous plot of land, or to be buried among his family, or for the convenience of his family visiting his grave.
