What is the ruling on a woman marrying another man while she is still in the marital bond with her first husband, with the second husband's knowledge of that, and the court's approval of this marriage and its affirmation of the child's lineage to them?
" المحصنات" (chaste women) are married women. And whoever is under the protection of a man is forbidden to others until he separates from her. Therefore, the marriage of this woman is invalid and forbidden, and her relationship with the second man is adultery (zina). Any child resulting from this union is illegitimate and cannot be attributed to the adulterer. A Sharia court cannot authorize such a marriage unless the first marriage is annulled for a reason necessitating annulment, or if the court rules for the woman's divorce from her first husband for a reason requiring it. As long as the first husband has not divorced or the waiting period (iddah) from him has not ended, the child is attributed to him, unless he denies paternity through the process of li'an (mutual imprecation).
