The heirs are the male children of the brother if they are his 'asabah (agnate heirs) (children of a full-brother or a paternal-brother). The children of a full-brother exclude the children of a paternal-brother. As for the daughters of the brother, they are from among the 'dhawu al-arham' (relatives by blood, but not agnate heirs) and do not inherit. The matter of estates must be referred to the courts for investigation, as there may be other heirs, or wills, or debts that take precedence over the rights of the heirs.
