Do the sister's or brother's daughters inherit their deceased paternal uncle who has no children?

If your uncle has no relatives other than his nephews (sons of his brother), his nieces (daughters of his brother), and his sister's daughters, then all that he leaves belongs exclusively to his nephews (sons of his brother), to the exclusion of the females and the sister's daughters. This is because the latter are considered "dhawu al-arham" (relatives by kinship) and do not inherit when there are "asabah" (agnate heirs). The brother's daughters do not inherit from their uncle because they are not among the "asabah" nor do they have a prescribed share. Brothers do not make their sisters "asabah" unless they are siblings of the deceased. It is recommended for these brothers to give their sisters a portion of the inheritance, in compliance with the words of Allah the Almighty: "And when [other] relatives and orphans and the needy are present at the division [of inheritance], then give them [something] from it and speak to them words of appropriate kindness." Finally, matters of inheritance must be referred to the Sharia courts for investigation, as there may be wills, debts, or other rights that take precedence over the right of the heirs.
