Is a girl considered disobedient to her guardian if she takes her case to a judge to compel the guardian to marry her off?

If a child has a legitimate right over his father and takes him to the ruler, this is not considered an act of disobedience (عقوق). It is not permissible for a father to prevent his daughter from marrying if she desires marriage and a suitable suitor proposes to her. Marriage is a right for the girl, and obedience to parents is only in what is good (ma'ruf). Their prevention of marriage is not from what is good, so obedience to them in this matter is not obligatory. This is supported by the fact that the Prophet, peace and blessings be upon him, gave a choice to the slave girl whose father married her off against her will, thus validating her permission and consent. A girl taking her case to the judge to prevent injustice from her father is not considered an act of disobedience, because the Prophet, peace and blessings be upon him, did not say so.
