Is it permissible to act upon a Mawquf tradition (athar mawquf) in an issue for which there is no Marfu‘ hadith, such as raising the hands in the Eid prayers?
A Mawqoof (멈춤) tradition is of two types:
First: That in which there is room for personal opinion (ra'y). This is not considered a proof unless other Companions agree with it.
Second: That in which there is no room for personal opinion. This type takes the ruling of a Marfoo' (elevated) tradition. If there is an indication that it is Marfoo', then it takes the ruling of a Marfoo' tradition.
The majority of scholars hold that a Mawqoof tradition does not have the ruling of a Marfoo' . Al-Ghazali held that the saying of a Companion is not a proof because a Companion can err or forget, and their infallibility is not established.
Raising the hands during the Eid prayers is practiced by the majority of scholars. Malik and Al-Thawri differed on this. The majority of scholars based their view on the fact that the Prophet, peace and blessings be upon him, used to raise his hands with the takbir.
