Is it permissible for a wife to swear an oath upon her husband that he not approach her for three months? Is any expiation (kaffarah) obligatory upon her or upon him if the husband has intercourse with her on the same day, contrary to her oath? And is the husband considered at fault for not accepting her oath?

A wife does not have the right to swear an oath to her husband that he should not have intercourse with her, because intercourse with her is a right of the husband, and she does not have the right to prevent him from it. If the husband breaks the oath, the wife must offer expiation for her oath, and the husband is not obligated to do anything. The jurists have stipulated that if someone swears an oath concerning a person over whom they have no authority, and that person disobeys, the one who swore the oath is absolutely obligated to offer expiation for a broken oath.
