The deceased's living children, male and female, inherit from him, as Allah Almighty says: "Allah instructs you concerning your children: for the male, what is equal to the share of two females." It is permissible for a brother who raises orphans to eat and drink from their wealth in a reasonable manner, and to mix the food of the adult with the food of the child without extravagance, as Allah Almighty says: "And if you mix with them, they are your brethren." What the brother used to give his father, if it was a loan, then it is part of the inheritance. If it was assistance, then he is not obliged to give it to the children unless out of generosity or because of their need. The debts owed by the father to creditors are considered part of the inheritance. The monthly income, if it was from his previously determined salary, then it is part of the inheritance. If it is paid to the children after death, then it follows the law of the disbursing authority. The income and inheritance are divided among the children, and each one is spent on from his own private wealth according to his need; otherwise, his guardian should consider his affair.
