The fatwa we uphold is that divorce pronounced during menstruation or a period of purity in which intercourse occurred is valid, despite its being an innovation (bid'ah). Also, the divorce of an angry person is valid unless he has completely lost his sanity. Some scholars (like Ibn Taymiyyah) are of the opinion that innovative divorce is not effective, nor is the divorce of an angry person if his anger is severe. There is no harm in acting upon the opinion of a trustworthy scholar in matters of differing opinions, provided that the enquirer is confident in the correctness of that opinion and does not follow his whims. It is advisable to present the matter to a trustworthy scholar and act upon his ruling.
