"Breaking a man's leg by mistake" does not necessitate a fixed blood money (Diyya Muqaddarah). Rather, it requires a fair compensation (Hukūmat al-Adl) estimated by the judge, and this is the view of the majority of scholars. The Malikis hold that if the leg heals and returns to its previous state, there is nothing due for it; otherwise, there is compensation. If the victim pardons and waives his right, then there is nothing upon the perpetrator.
