If the father divorced his wife three times, then took her back before she married another man, or divorced her less than three times and her waiting period expired, then took her back without a new contract, then cohabiting with her is forbidden. The wife must not allow him to approach her if she knows this.

The children must advise their father gently and politely, enjoining what is good and forbidding what is evil. If the father insists on cohabiting with her unlawfully, silence is not permissible. Rather, the matter must be brought before the Shariah judge to separate them if it is proven to him that she is not lawful for him. An exception to this is if the father’s cohabitation with her is based on a fatwa from someone whose knowledge and piety are trusted.
